License Grant The ATSEA Program grants the Licensee a royalty-free, non-exclusive, and non-transferable license to use, reproduce, modify, print, and combine the Data with other data in their possession.
Restrictions on Use The Licensee is prohibited from commercialising the Data or any product or service derived from it. The Data may only be used for non-commercial, educational, research, policy development, or environmental management purposes, unless otherwise agreed in writing by the ATSEA Program.
Intellectual Property Rights The ATSEA Program guarantees that the Data provided under this License does not infringe upon any third-party Intellectual Property Rights. The Program will disseminate the Data in accordance with any agreements made with the original data sources.
Data Updates and Versioning The ATSEA Program may update or revise the Data at any time. The Licensee is responsible for ensuring they are using the most recent version of the Data, unless a specific version was agreed upon in writing.
Third-Party and Contributor Data Data identified as being derived from individual contributors may be subject to additional terms and conditions set by the data provider and/or specified in the associated metadata.
Data Security The Licensee must store the Data securely and ensure it remains protected from unauthorised access or use.
Use of Photos and Figures Use of photographs, maps, or figures included in the Data or related reports must not be reproduced or shared without explicit permission from the respective copyright holders.
Subsequent Access The Licensee must ensure that any third parties granted access to the Data are made aware of, and comply with, these Terms and Conditions.
Attribution The Licensee must acknowledge the ATSEA Program as the data provider in any use, publication, or presentation involving the Data. Such acknowledgment must be accompanied by attribution to the ATSEA Program as follows: Arafura and Timor Seas Ecosystem Action (ATSEA) Program – www.atsea-program.com.
Final Deliverables The Licensee must submit a copy of any final report or product resulting from the use of the Data to the ATSEA Program.
Disclaimer The ATSEA Program provides the Data “as is” and does not guarantee that it is error-free. No warranties are made regarding the language, quality, performance, or fitness of the Data for any specific purpose.
The contents of the Data do not necessarily reflect the views or policies of the ATSEA Program, its member countries, or its implementing partners. Geographic names and boundaries used in the Data do not imply any official position or legal status.
Responsibility The Licensee is solely responsible for the selection and use of the Data, including the interpretation of any outcomes. Caution must be exercised when drawing conclusions based on the Data.
Authority By agreeing to these Terms on behalf of a company or organisation, the individual confirms they have the authority to do so.
